1. Agreement and scope
These Terms of Service (the "Terms") govern access to and use of the Gubify mobile application, gubify.com and related beta, support, feedback, Community discovery and account-management services (together, the "Service").
By creating or using a Gubify account, accepting these Terms in the app, or using a feature that requires acceptance, you agree to these Terms and to the Community Guidelines. The Privacy Policy explains how Gubify processes personal data and is separate from these Terms.
If you do not agree to these Terms or the Community Guidelines, you must not use the parts of the Service that require acceptance.
2. Service provider
Gubify is currently operated as a personal initiative in Italy rather than as an incorporated company. References to "Gubify", "we", "us" or "our" mean the operator of the Service.
Legal enquiries may be sent to legal@gubify.com. Privacy enquiries may be sent to privacy@gubify.com and general support enquiries to support@gubify.com.
3. Eligibility and age requirement
You must be at least 16 years old to create or use a Gubify account. Gubify is not intended for children under 16.
If you are under the age of legal majority in your country, you may use Gubify only where permitted by applicable law and with any parental or guardian authorisation that may be required. By using Gubify, you represent that you satisfy the applicable eligibility requirements.
Gubify may restrict or terminate access where it reasonably determines that the age or legal-capacity requirements are not met.
4. Accounts and authentication
Gubify may create a technical user identity through Firebase Authentication and may support account access or account securing through Google Sign-In, email and password, and other methods introduced in the future.
You are responsible for maintaining the security of your device, password and linked third-party accounts and for activity carried out through your Gubify identity. You must not access another person's account without permission, impersonate another person or organisation, or create accounts for unlawful, deceptive or abusive purposes.
If you believe your account or linked credentials have been compromised, you should promptly secure the relevant credentials and contact Gubify. Gubify may temporarily limit account activity where reasonably necessary to investigate suspected compromise, fraud or abuse.
5. The Gubify Service
Gubify is designed to help people communicate, organise activities and coordinate shared information. Features may include Private Gubs, public Communities, chat, Board posts, tasks, events, proposals, voting, Shared Budget, profiles, invitations, Community discovery, public Community web pages, images, Ask/answer features and notifications.
Features may be added, changed, limited, renamed or removed as the Service evolves. Availability may differ between beta versions, devices, countries and accounts.
Gubify may impose reasonable technical, security, anti-abuse or usage limits to protect the Service and its users.
6. Private Gubs
A Private Gub is intended to be accessible only to authorised members according to the permissions of the relevant feature. Gubify does not intentionally publish Private Gub content as a publicly indexable web page.
Private does not mean that another member is technically prevented from taking a screenshot, copying information, photographing a screen or sharing information outside Gubify. Users should therefore share information only with people they trust and should not use a Private Gub as a substitute for a legally protected confidential communications system.
The Community Guidelines and moderation rules also apply inside Private Gubs. Content from a Private Gub may be included in a report to Gubify when a user uses an available reporting mechanism.
7. Public Communities and web discovery
Public Communities are designed for discovery. When you create or manage a public Community, you understand that selected Community information may be displayed on gubify.com and may become accessible to search engines and other third-party indexing services.
Public information may include the Community name, slug, description, image, language, access mode, member count or other discovery information made public by the relevant feature. Member-only chat and other content are not made publicly accessible solely because the Community has a public discovery page, unless a feature clearly states otherwise.
You must not place another person's sensitive, confidential or private information in publicly visible Community fields unless you are authorised to do so.
If a Community is removed, hidden or renamed, third-party search engines may take time to update cached or indexed information. Gubify does not control those third-party update schedules.
8. Community ownership and roles
Community owners and authorised roles may have additional controls over membership, access, settings and content. They must use those controls responsibly and in accordance with these Terms and the Community Guidelines.
A Community owner, moderator or member is not an employee, agent, partner, representative or spokesperson of Gubify merely because of that role. Users must not falsely present a Community as officially endorsed, operated or verified by Gubify.
Ownership of a Community does not provide immunity from moderation. Gubify may take action against a Community, its owner or its members where necessary for safety, legal compliance, policy enforcement or protection of the Service.
9. User Content and licence
You retain ownership of original text, images and other material that you create and submit to Gubify ("User Content"), subject to any rights of third parties. You are responsible for ensuring that you have the rights and permissions necessary to submit and share that content.
To operate the Service, you grant Gubify a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, transmit, format, resize, technically process and display User Content only as reasonably necessary to provide, secure, moderate, maintain and improve the features you choose to use.
For public Community information, this licence includes displaying the relevant public information on Gubify web pages and making those pages technically available to search engines and link-preview services.
The licence ends when the relevant content is deleted from the Service, except to the extent that anonymised shared records, temporary backups, moderation or security records, legal obligations, or content already lawfully shared with others require limited continued processing.
10. Community Guidelines and acceptable use
The Community Guidelines form part of these Terms. You must comply with them whenever you use Gubify, including in Private Gubs and public Communities.
Without limitation, you may not use Gubify to create, upload, share, organise, promote or facilitate unlawful activity; threats or violence; harassment, bullying or stalking; hateful or discriminatory abuse; child sexual abuse or exploitation; pornographic or sexually explicit content prohibited by the Guidelines; non-consensual intimate content; fraud, scams or phishing; malicious software; doxxing; unlawful sales; intellectual-property infringement; spam; impersonation; or attempts to bypass security or moderation controls.
Context, severity, intent, risk, applicable law and repeated behaviour may be considered when Gubify assesses a possible violation.
11. Privacy between users and confidentiality
Gubify provides technical access controls for relevant features, but cannot guarantee that another authorised recipient will keep shared information confidential. Users are responsible for deciding what information to share with other members.
You must respect the privacy and confidentiality of other users. You must not publish another person's private information, credentials, home address, private communications or other protected information without a lawful basis or permission.
Nothing in this section limits Gubify's own obligations under applicable privacy and data-protection law.
12. Reports, blocking and moderation
Gubify provides reporting and blocking mechanisms for supported areas of the Service. Reports may concern users, messages, Communities, Ask content, answers or other supported content. A report may contain a snapshot of the reported content and information needed to evaluate the report.
Blocking is a personal safety and interaction control. Blocking another user does not necessarily delete that user's content, remove them from all shared spaces, or amount to a platform-wide enforcement decision.
Gubify may investigate reports, review relevant records and take proportionate action. Available actions may include warnings, content restrictions, feature restrictions, removal from discovery, joining restrictions, Community chat restrictions, Community restrictions, suspension or termination where technically available and legally appropriate.
No report guarantees a particular outcome. Gubify may consider the available evidence, context, severity, risk, history, safety concerns and applicable law. Gubify is not required to disclose information that would compromise another person's privacy, safety, security controls or a lawful investigation.
13. Restrictions, suspension, termination and circumvention
Gubify may restrict a feature, Community or account where reasonably necessary to enforce these Terms or the Community Guidelines, protect users or the Service, respond to legal requirements, investigate abuse or reduce an immediate safety or security risk.
Where appropriate and legally required, Gubify will provide information about the reason for a moderation decision and a reasonable way to request review. A review request may be handled through support or another mechanism made available by Gubify.
You must not evade or attempt to evade a restriction, suspension, Community limitation or termination by creating or using other accounts, identities, devices or Communities for the purpose of circumventing enforcement.
Nothing in these Terms requires Gubify to keep an account active where continued access would create an unacceptable safety, legal or security risk.
15. Names, slugs, trademarks and impersonation
Community names, usernames, slugs and other identifiers do not grant ownership of a word, brand, trademark, public figure identity or organisation name.
Gubify may rename, restrict, remove or, where appropriate, reassign an identifier if it infringes third-party rights, creates a material risk of impersonation or deception, violates these Terms, or is reasonably required for technical, legal or safety reasons.
Users must not falsely imply endorsement, verification, sponsorship or official status by Gubify or by a third party.
16. Discovery, ranking and search-engine visibility
Appearance in Community discovery, featured areas, category results, popularity lists or search results is not guaranteed. Gubify may use signals such as category, language, access mode, member count, activity, relevance, safety or other product criteria when organising discovery features.
Gubify may change discovery criteria and may remove or reduce the visibility of a Community for safety, quality, abuse prevention, legal or product reasons.
Gubify does not guarantee that a public Community will be indexed by Google or another search engine, achieve any ranking, receive traffic or remain indexed. Search engines operate independently of Gubify.
18. Tasks, proposals, votes and events
Tasks, assignments, proposals, votes, calendar entries and organised events are coordination tools. Unless users separately create a legally binding agreement under applicable law, an action inside Gubify does not by itself create employment, agency, partnership, fiduciary, financial or contractual obligations between users or with Gubify.
Users remain responsible for verifying real-world arrangements, permissions, costs, safety requirements and factual information connected with activities organised through Gubify.
19. Interactions and transactions between users
Gubify is not a party to private arrangements, exchanges, sales, payments or agreements between users unless Gubify expressly states otherwise for a specific future service.
Users are responsible for exercising appropriate caution before transferring money, meeting another person, relying on advice or entering into an agreement with another user. Reports of suspected fraud or illegal conduct may be investigated under the moderation rules.
20. Third-party services and external links
Gubify relies on third-party infrastructure and platform services, including Google Firebase, Cloudflare and Cloudinary. Other providers may be introduced where reasonably necessary to operate the Service and will be reflected in applicable privacy disclosures where they process personal data.
Third-party services may experience interruptions or apply their own terms. Gubify does not control the availability, policies or content of independent third-party services.
Links posted by users may lead to external websites or services. A link does not imply endorsement by Gubify. Users should exercise caution before entering credentials, making payments or downloading files from external services.
21. Beta, availability, changes and continuity
Beta or pre-release versions may contain bugs, incomplete features, temporary limitations, migrations or changes. Gubify may need to reset, migrate, repair or remove test data where reasonably necessary for development, security or reliability.
Gubify does not guarantee uninterrupted or error-free availability. Maintenance, security incidents, device limitations, network failures or third-party outages may affect the Service.
Gubify may modify, discontinue or replace a feature or, if necessary, the Service itself. Where a change materially affects users or paid rights, Gubify will provide notice or remedies where required by applicable law.
22. Future paid features, subscriptions and promotions
Gubify may introduce optional paid features, subscriptions, premium Community tools, additional storage or functionality, sponsorships, advertising or promotional services in the future. Their inclusion in these Terms does not mean that any such feature is currently available.
No user will be charged merely because a paid feature is introduced. Before a purchase, the applicable price, billing period, renewal conditions and material terms will be presented as required by law and the relevant app-store rules.
Where purchases are processed through an app store or payment provider, additional terms may apply. Mandatory consumer rights, including applicable cancellation, withdrawal or refund rights, are not excluded by these Terms.
If Gubify later introduces advertising or tracking technologies that change the processing of personal data, the Privacy Policy and any required consent mechanisms will be updated before or when that processing begins.
23. Account deletion
Gubify provides an account-deletion process in the app and a web-based deletion request resource. To protect shared spaces and ownership integrity, an account cannot complete in-app deletion while it still owns a Private Gub or Community; the user must first resolve that ownership using the options made available by Gubify or contact support if assistance is needed.
Account deletion may require reauthentication. When deletion completes, Gubify removes the user's account/profile data and memberships within the implemented deletion workflow. Certain shared records may remain in anonymised form so that collaborative histories remain coherent. For example, shared chat messages may remain but identify the author as "Deleted user".
Certain information may also be retained where and for as long as reasonably necessary for legal obligations, security, fraud or abuse prevention, dispute resolution or the establishment, exercise or defence of legal claims, as explained in the Privacy Policy.
24. Feedback
Users may send suggestions, bug reports and other feedback. Feedback does not create a right to compensation, attribution, exclusivity, implementation or an individual response.
You grant Gubify permission to review, analyse, reproduce internally and use submitted feedback to evaluate, develop, secure and improve the Service, without acquiring ownership of unrelated User Content.
25. Gubify intellectual property
Gubify and its licensors retain all rights in the Gubify name, logos, branding, software, interfaces, original artwork, website design, documentation and other materials supplied by Gubify, excluding User Content.
Subject to these Terms, Gubify grants you a limited, personal, revocable, non-exclusive and non-transferable right to use the Service for its intended purpose. You may not copy, sell, sublicense, scrape, exploit or create unauthorised derivative services from Gubify except where applicable law expressly permits it.
26. No professional advice and no emergency service
Content created by users may concern health, law, finance, employment, fitness, technology or other specialised topics. User Content does not represent advice, endorsement or verification by Gubify, and Gubify does not guarantee its accuracy.
Gubify is not an emergency communications service and should not be relied on for emergency response, medical emergencies, public safety, critical infrastructure or situations where delayed or unavailable communication could cause serious harm.
27. Disclaimers
To the maximum extent permitted by applicable law, the Service is provided on an "as available" basis. Gubify does not guarantee uninterrupted availability, perfect accuracy, a particular Community audience, search ranking, compatibility with every device or that every item of User Content will be reviewed before publication.
Gubify does not endorse User Content merely because it is available through the Service. Users remain responsible for their own content, decisions and interactions.
Nothing in these Terms excludes warranties, remedies or other rights that cannot lawfully be excluded or limited, including mandatory consumer rights.
28. Limitation of liability
To the maximum extent permitted by applicable law, Gubify is not responsible for losses caused solely by User Content, unauthorised disclosure by another user, independent third-party services, user-to-user arrangements, or events outside Gubify's reasonable control, except where Gubify is legally responsible for the relevant loss.
Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law, including liability arising from fraud, wilful misconduct, gross negligence where applicable, or mandatory consumer and data-protection obligations.
Users remain responsible for losses or claims resulting from their own unlawful use of the Service, infringement of third-party rights or deliberate violation of these Terms, to the extent permitted by applicable law.
29. Changes to these Terms
Gubify may update these Terms to reflect changes in the Service, law, safety requirements or business model. The current version and update date will be published with the Terms.
Where a change is material, Gubify will provide notice and request renewed acceptance where reasonably appropriate or legally required. Continued use after an effective update may constitute acceptance only where permitted by applicable law and after any required notice.
30. Governing law and disputes
These Terms are governed by Italian law, without depriving a consumer of mandatory protections granted by the law that applies to that consumer.
Any dispute will be subject to the courts determined by applicable mandatory law. Nothing in these Terms requires a consumer to waive a mandatory right to bring a claim before a court that has jurisdiction under applicable consumer-protection rules.
Users are encouraged to contact legal@gubify.com before commencing formal proceedings where an informal resolution may be possible.
31. General provisions
If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in effect to the extent permitted by law. A failure by Gubify to enforce a provision on one occasion is not a waiver of the right to enforce it later.
Where additional feature-specific terms are introduced, those specific terms apply to that feature and prevail only to the extent of an actual conflict with these Terms.
Provisions that by their nature should survive termination - including intellectual-property, responsibility, dispute, moderation-record and limitation provisions - may continue to apply after an account is closed to the extent legally necessary.
